The Regular Meeting of the Board of Supervisors of East Norriton Township was called to order by the Chairman, Mr. Donald Gracia, at 7:05 p.m. on Tuesday, June 27, 2006, at the Township Municipal Building. Supervisors present were Donald J. Gracia, Lewis K. McQuirns, James K. Staufenberg, and Karen “Kandy” Heckman. Supervisor James J. Serratore was absent.
Following roll call, Mr. Gracia offered a prayer and the Pledge of Allegiance was then recited by all in attendance.
The Chairman introduced the first item on the agenda, Swearing in of Assistant Fire Marshal – James Staufenberg. Assistant Township Manager, Mr. Donald Delamater swore in Assistant Fire Marshal, James Staufenberg.
The Chairman introduced the next item on the agenda, Swearing in of Fire Police Officer – John Killen. Assistant Township Manager, Mr. Donald Delamater swore in Fire Police Officer, John Killen.
The Chairman introduced the next item on the agenda, Affirm Promotion to Sergeant – Officer Ryan Stinson. Mr. Staufenberg made a motion to approve Officer Ryan Stinson’s promotion to Sergeant per Police Chief, John McGowan’s memo dated June 1, 2006. After requesting any comments and there being none, the motion was seconded by Mrs. Heckman and approved unanimously.
The Chairman introduced the next item on the agenda, Police Officer Commendation. Police Chief, John McGowan presented Detective Jean Morrison with a commendation for her hard work and dedication with the Montgomery District Attorney’s Office Internet Crime Against Children Task Force.
The Chairman introduced the next item on the agenda, Resolution No. 2296 – Penn Star Medical Evacuation. Mrs. Heckman made a motion to approve Resolution No. 2296 declaring Penn STAR Flight as the primary air medical service of the Township. After requesting any comments and there being none, the motion was seconded by Mr. Staufenberg and approved unanimously.
The Chairman introduced the next item on the agenda, Clemens Meat Market Sixtieth Anniversary. Township Manager, Mr. Helmuth Baerwald read into record the certificate to be presented to Clemens Meat Market.
The Chairman announced that on June 14, 2006 East Norriton Township was the proud recipient of the Greater Valley Forge Transportation Association Public Sector Award for the efforts of the Township to address Township and regional traffic issues.
The Chairman introduced the next item on the agenda, Authorize Bids for Sewer Lateral Repairs. Mrs. Heckman made a motion to authorize advertisement of bids for sewer lateral repairs to be opened at the July or August regular meeting. After requesting any comments and there being none, the motion was seconded by Mr. Staufenberg and approved unanimously.
The Chairman announced that the Board of Supervisors met on June 6th, 2006 in a Workshop Meeting and earlier this evening in Executive Session to discuss matters of litigation and personnel.
Mr. Staufenberg made a motion to approve the minutes of the Regular Meeting of May 23, 2006 and the Workshop Meeting held on June 2, 2006. After requesting any comments and there being none, the motion was seconded by Mr. McQuirns and approved unanimously.
Mr. Staufenberg made a motion to approve the Finance Reports for May, 2006. After requesting any comments and there being none, the motion was seconded by Mr. McQuirns and approved unanimously.
The Chairman requested that the reading of the Committee Reports for May, 2006 be deferred and also commented that the Committee Reports were available on the table in the back of the meeting room. Mr. McQuirns made a motion to approve the Committee Reports for May, 2006. After requesting any comments and there being none, the motion was seconded by Mr. Staufenberg and approved unanimously.
Mr. McQuirns introduced the first item under “Old Business”, Gill Quarries Report. Township Solicitor, Christen Pionzio reported the Township is still waiting to hear about the appeal.
Mr. McQuirns introduced the next item on the agenda, Johnson Highway Addresses – Authorize Advertisement of Ordinance. Township Solicitor, Christen Pionzio reviewed the proposed ordinance which sets the new street numbers for the properties along Johnson Highway and set the implementation date of November 1, 2006. Based on a request from Erich Beerer, Beerer Realty’s new number will be four hundred one. Mr. McQuirns made a motion to authorize advertisement of the proposed ordinance. After requesting any comments and there being none, the motion was seconded by Mr. Staufenberg and approved unanimously.
Mr. McQuirns introduced the next item on the agenda, Sanitary Sewer Inflow and Infiltration and CAP Report and Authorize Release of EDU’s. Mr. Matt Brown of ARRO Consulting provided a status report on the Corrective Action Plan for East Norriton Township and reviewed the letter dated May 31, 2006 from the Department of Environmental Protection on the Germantown Pike Pumping Station. Township Manager, Mr. Helmuth Baerwald read into record a memo from Zoning Officer, Mr. Bruce Shoupe dated June 22, 2006 recommending EDU releases. Mr. McQuirns made a motion to authorize the release of sewer connections (EDU’s) per Mr. Shoupe’s memo dated June 22, 2006. After requesting any comments and there being none, the motion was seconded by Mr. Staufenberg and approved unanimously.
Mr. Staufenberg made a motion to schedule a public informational meeting on Monday, July 24th, 2006 at 7:00 p.m. at the Paul Fly Elementary School gym for the residents of the western end of the Township concerning the Inflow and Infiltration. After requesting any comments and there being none, the motion was seconded by Mr. McQuirns and approved unanimously.
Mr. McQuirns introduced the next item on the agenda, Corrective Action Plan – East Norriton Whitpain Plymouth Joint Sewer Authority. Mr. Matt Brown of ARRO Consulting provided a brief overview of the Corrective Action Plan for the Joint Sewer Authority and reviewed recent correspondence from the Department of Environmental Protection on the status of the sewer hook-up moratorium for the authority.
Mr. McQuirns introduced the next item on the agenda, Open Space Plan. Township Manager, Mr. Helmuth Baerwald briefly reviewed the Township Planner’s Open Space submission to the Montgomery County Open Space Board.
Mr. McQuirns introduced the next item on the agenda, Developments and Construction Updates. Zoning Officer, Mr. Bruce Shoupe reported: Potshop and Germantown Pike – proposed age restricted development; Pimlico Farms – five building permits issued out of the forty-six lot single family subdivision; Reserve at Penn Crossing – thirty-nine building permits have been issued, thirteen units have gone to settlement out of the seventy-eight units in the development; Jefferson Crossing – phase one under construction, the Township has issued permits for the three model homes; Mercy Suburban Hospital – expanded emergency room now open, second floor operating rooms looking at July occupancy and the third floor will be additional intensive care units; East Norriton Middle School – old portion under renovation looking at September occupancy; Heatherwood Development – twenty-eight lot subdivision developer finalizing plans with an anticipated start in the next sixty days; DeSage property – building now occupied with an orthopedic surgeon; MRA Carwash – under building, sewer main replacement is being reviewed, looking at September opening; Evergreen Terrace – ten lot subdivision still under review; and Northwoods – proposed flex development going through review process.
Mr. McQuirns introduced the next item on the agenda, Storm Drainage Issues/Projects. Township Engineer, Mr. Robert Blue reported: A. North Whitehall and Township Line Roads storm drainage work project - work is pending scheduling and full funding; B. Briar Lane and Hillcrest Avenue Watershed – pending funding; C. Lawnton Road, Lafayette and Springview Roads storm water system design plans - course of action to be determined; D. Faith Drive – Township Solicitor sent a letter to residents at 501 and 503 regarding water issue being a private matter; E. 605 Meadowbrook Road – pending funding; and F. sanitary sewer manhole located behind Stony Creek Road – met with DEP, to review.
Mr. McQuirns introduced the next item on the agenda, Traffic Issues. Zoning Officer, Mr. Bruce Shoupe reported: A. Germantown Pike/Whitehall Road – waiting for utility pole to be relocated; B. Township Line Road traffic study – proceeding. Zoning Officer, Bruce Shoupe reviewed a proposed development in Worcester Township; and C. Germantown Pike Corridor study is pending funding by the County and Township’s.
Mr. McQuirns introduced the next item on the agenda, US Route 202 Widening. Zoning Officer, Bruce Shoupe reported that the East Norriton section is scheduled to start in the Fall of 2007.
Mr. McQuirns introduced the next item on the agenda, School Resource Officer Grant status. Police Chief, John McGowan reported that there is no grant money available for this year. The Township will reapply in September. Mr. Staufenberg made a motion to authorize Chief McGowan to proceed with the September application. After requesting any comments and there being none, the motion was seconded by Mr. McQuirns and approved unanimously.
Mr. Staufenberg introduced the first item under “New Business”, Resolution No. 2031 – Montgomery County Traffic Incident Management Plan. Police Chief, John McGowan briefly reviewed Resolution No. 2301. Mr. Staufenberg made a motion to approve Resolution No. 2031 – Montgomery County Traffic Incident Management Plan. After requesting any comments and there being none, the motion was seconded by Mrs. Heckman and approved unanimously.
Mrs. Heckman introduced the next item on the agenda, Resolution No. 2302 – Authorize the Execution of Retiree Health Savings Plan. Assistant Township Manager, Donald Delamater reviewed Resolution No. 2302 Authorizing the Execution of the Retiree Health Savings Plan. Mr. Staufenberg made a motion to approve Resolution No. 2302. After requesting any comments and there being none, the motion was seconded by Mrs. Heckman and approved unanimously.
Mr. Staufenberg introduced the next item on the agenda, Resolution No. 2303 – Authorize Advertisement of two police vehicles and sweeper for bid. Mr. Staufenberg made a motion to authorize advertisement of the two 2003 Ford Crown Victoria’s for bid for opening at the regular July meeting and to change the 1988 Ford/Tymco sweeper for bid opening at the regular August meeting after advertising in the PSATS magazine. After requesting any comments and there being none, the motion was seconded by Mrs. Heckman and approved unanimously.
Mrs. Heckman introduced the next item on the agenda, Resolution No. 2304 – Permit Fee Schedule. Zoning Officer, Bruce Shoupe reviewed Resolution No. 2304 setting a schedule of fees for zoning, land development, subdivision, building, plumbing, fire and other associated charges in the Township. Mrs. Heckman made a motion to approve Resolution No. 2304. After requesting any comments and there being none, the motion was seconded by Mr. Staufenberg and approved unanimously.
Mr. Staufenberg introduced the next item on the agenda, Resolution No. 2305 – Williamstadt and Resolution No. 2306 – 317 West Germantown Pike Sewer Planning Modules. Zoning Officer, Bruce Shoupe reviewed the sewer planning modules for Williamstadt and 317 West Germantown Pike. Mr. Staufenberg made a motion to approve Resolution No. 2305 - Williamstadt. After requesting any comments and there being none, the motion was seconded by Mrs. Heckman and approved unanimously. Mr. Staufenberg made a motion to approve Resolution No. 2306 – 317 West Germantown Pike. After requesting any comments and there being none, the motion was seconded by Mrs. Heckman and approved unanimously.
Mrs. Heckman introduced the next item on the agenda, Resolution No. 2307 – Northwoods Development. A representative for the developer provided a brief presentation of the proposed Northwoods Development. Also, reviewed over the commitments made to the Court at Jamestown development which will be part of a separate agreement. Mrs. Heckman made a motion to approve Resolution No. 2307. After requesting any comments and there being none, the motion was seconded by Mr. Staufenberg and approved unanimously.
Mr. Staufenberg introduced the next item on the agenda, Resolution No. 2309 -317 West Germantown Pike Development. A representative for the developer provided a brief presentation of the proposed development for 317 West Germantown Pike. Mrs. Heckman made a motion to approve Resolution No. 2309. After requesting any comments and there being none, the motion was seconded by Mr. McQuirns and approved three to one with Mr. Staufenberg opposing. Mr. Staufenberg expressed concerns with the access in and out the site.
Mrs. Heckman introduced the next item on the agenda, Budget Revisions. Assistant Township Manager, Donald Delamater reviewed the budget revisions as of June 1, 2006. Mrs. Heckman made a motion to approve the budget revisions. After requesting any comments and there being none, the motion was seconded by Mr. Staufenberg and approved unanimously.
Mr. Staufenberg introduced the next item on the agenda, Norristown ASA Ballfields Driveway Entrance. Township Manager, Mr. Helmuth Baerwald reviewed that Norristown needs authorization to run the road to the new ballfield on an existing farm road located within the Township’s boundaries on the East Norriton side of the border. Mr. Staufenberg made a motion to approve the request of Norristown to use the existing farm road. After requesting any comments and there being none, the motion was seconded by Mrs. Heckman and approved unanimously.
Mrs. Heckman introduced the next item on the agenda, Schedule NIMS Training for Supervisors’ ICS Certification. Mrs. Heckman made a motion to set a training date of Saturday, July 22, 2006 for the ICS Certification, required by law to be completed by the Supervisors, Manager and Assistant Manager. After requesting any comments and there being none, the motion was seconded by Mr. Staufenberg and approved unanimously.
Mr. Staufenberg introduced the next item on the agenda, Cable Franchise Legislation. Township Manager, Mr. Helmuth Baerwald reviewed the proposed legislation. Mr. Staufenberg made a motion to affirm the Consortium’s agreement with Verizon. After requesting any comments and there being none, the motion was seconded by Mr. McQuirns and approved unanimously.
Mrs. Heckman introduced the next item on the agenda, Veteran’s Memorial. This is an informational item; Township Manager, Mr. Helmuth Baerwald reviewed the erroneous advertisement for the ceremony at the Veteran’s Memorial on Memorial Day.
Mr. Staufenberg introduced the next item on the agenda, Veteran’s Memorial – Request for Blue Star Memorial Highway signage. The Township has received a request from the Norristown Garden Club to erect a Blue Star Memorial Highway marker in the area of the Veteran’s Memorial. Mr. Staufenberg made a motion to refer this request to the Veteran’s Committee for review and recommendation. After requesting any comments and there being none, the motion was seconded by Mrs. Heckman and approved unanimously.
Mrs. Heckman introduced the next item on the agenda, Germantown Pike Corridor Resurfacing. This is an informational item; the County is going out for bid to “resurface” from curb to curb the Germantown Pike corridor from Church Road in Worcester Township to Jolly Road in Plymouth Township. The paving work will be performed during the hours of 10:00 p.m. to 6:00 a.m., with the County picking up the cost of replacing all the loops, re-do all of the striping at the intersections and recast all of the sewer manholes (approximately seventy in each Township). Township staff has been invited to a pre-job meeting in order to coordinate all of the various issues and prepare a notification to all property and business owners. No exact date has yet been set for the actual paving but it is expected to be in late August or early September of this year.
Mr. Staufenberg introduced the next item on the agenda, Schedule Meetings. Mr. Staufenberg made a motion to schedule a Workshop Meeting for Tuesday, July 11, 2006 at 6:00 p.m. and a meeting with the Norriton Fire Engine Company Board of Trustees and Personnel Committee for Thursday, July 27, 2006 at 6:00 p.m. After requesting any comments and there being none, the motion was seconded by Mrs. Heckman and approved unanimously.
Mrs. Heckman introduced the next item on the agenda, Expenditure Authorization. A. Montgomery County Lands Trust Donation - $50.00; B. DVIT – Insurance Deductible - $3,500.00; C. East/West Norriton Fire Company Golf Outing - $75.00 each; D. Penalty and Interest Waiver Request (Regal Petroleum) - $1,025.00; and E. Hydraulic Analysis Germantown Pike Pumping Station - $17,000.00. Mrs. Heckman made a motion to authorize items A through E. After requesting any comments and there being none, the motion was seconded by Mr. Staufenberg and approved unanimously.
Mr. Staufenberg introduced the next item on the agenda, Attendance Authorizations. A. Police Training – Officer Culbreath – September 19th; B. Police Training – Officers Thomson and Carfrey – September 6th and 7th; C. Police Training – Lieutenant Kates – October 30th – November 3rd; D. Police Training – Officers Patrick, Pasquale and Cafrey – August 28th – September 1st; and E. Police Training – Chief of Police Conference – October 15th – 18th. Mr. Staufenberg made a motion to authorize items A through E. After requesting any comments and there being none, the motion was seconded by Mrs. Heckman and approved unanimously.
Mrs. Heckman reviewed the meeting schedule for June 27, 2006 through September 26, 2006.
Township Manager, Mr. Helmuth Baerwald reviewed various legislation being reviewed by the State legislators.
Township Manager, Mr. Helmuth Baerwald reported that the Township is sending out a letter to the residents on Whitehall Road tomorrow regarding the Inflow and Infiltration and the televising of sewer laterals He also asked that people do not drive in high water due to the safety issue.
There being no other business to come before the Board, the Chairman asked if there were any residents who wished to speak. Mr. Papernick of 605 Meadowbrook Road questioned where the funding is coming from and when the repairs will be performed? Township Engineer, Robert Blue reviewed the issues with debris clogging the drains and the high cost of the project. Township staff will review and provide a more detailed report. The issue of funding the project remains.
Mrs. Heckman made a motion to adjourn the meeting at 8:55 p.m. After requesting any comments and there being none, the motion was seconded by Mr. Staufenberg and approved unanimously.
