Residential Resale Use & Occupancy

Before a building or home can be used, occupied, transferred or sold the Township must perform an inspection and issue a Use & Occupancy Permit. Among other things, the inspector will check for smoke detectors, illegal sump pump connections, sidewalks, curbing and other safety-related items. An inspection certificate from a recognized mechanical contractor is required to be submitted at the time of the inspection for all gas or oil fired furnaces and boilers stating that the heater is in safe working order.  Additionally, the sewer lateral is required to be inspected and certified by a licensed plumber.  A list of commonly deficient items requiring correction is listed on the back of the Use & Occupancy Permit application. Either the buyer or the seller may apply for a Use & Occupancy permit.

Upon receipt of a Use & Occupancy permit application and the requisite fee of $200.00, the inspector will schedule a day and time to meet the applicant at the property for the inspection.  Deficiencies discovered as a result of the inspections must be repaired before the property can be sold. Alternatively, either the buyer or seller, may post a cash escrow with the Township to ensure that repairs will be made by entering into a Resale Repair Agreement with the Township.

Importantly, the inspections performed by the Township should not be considered a substitute for what is commonly referred to as a "home inspection". The inspections do not represent any warranty on behalf of the Township and buyers are advised to arrange for an independent home inspection if they so desire.
